A 42-year-old man who raped a 12-year-old girl after her mother gave her permission to stop by his Southeast Portland apartment to watch a movie was sentenced to 25 years in prison Thursday.

Demarcus Ramone James, now 43, was a trusted adult in the girl’s life. On Aug. 8, 2017, the girl had asked her mother if she could walk a short distance to James’ apartment to watch a movie and her mother said yes, according to a probable cause
affidavit.

About 20 minutes later, the mother stopped by to check on her daughter and gave the girl 15 more minutes to finish watching the movie and then come home, investigators say.

About 15 minutes later, the girl rushed home crying, ran straight into the bathroom and shut the door, the affidavit states. The mother opened the door to discover “blood everywhere” and the girl said James had forced sex and other sexual acts on her,
investigators say.

The daughter, via TriMet bus, rode to a nearby hospital, where staff examined her for signs of sexual assault and collected DNA that matched James’.

James called 911 that night to report that two men had just burglarized his apartment, stabbed him in the shoulder and thrown him into his large TV, according to the affidavit. He later told police he made up that story to draw attention away from the
girl’s report. James initially denied touching the girl, but later claimed she came on to him.

James waived a jury trial in December and Multnomah County Circuit Judge Leslie Bottomly found him guilty of a long list of crimes, including first-degree rape, first-degree sodomy, first-degree sexual abuse and initiating a false police report.

Shortly after Bottomly read the verdict, James threw a cup of water at Deputy District Attorney Amanda Nadell. He was charged with harassment, and he pleaded guilty to that crime Thursday. He’ll be sentenced in April for that offense.

Deputy District Attorney Amity Girt handled the sentencing hearing in place of Nadell.

James’ defense attorney asked for eight years and four months, what he believed was the mandatory minimum under Oregon law. But Bottomly sentenced James to 25 years after the prosecutor argued that was the minimum -- because James committed “separate
criminal episodes” as he assaulted the girl in the living room, bathroom and bedroom of his apartment.
