    GWINNETT COUNTY, Ga. - A Gwinnett County family is demanding answers after learning that the man accused of killing their loved one is not in jail—eight months after the crime.

    Investigators say that Allen Dumas shot and killed 61-year-old Johnita Weaver last July on Glen Summit Lane in Snellville, before critically injuring himself in an apparent failed suicide attempt.

    What we know:
    Dumas was initially charged with felony murder and aggravated assault. However, Gwinnett County jail records show Dumas is not in custody, and court records indicate he is not out on bond.

    His current medical condition remains unclear.

    What they're saying:
    "This guy needs to be in the custody of Gwinnett County Sheriff’s Department," said Greg Weaver, the victim’s brother, as he held a picture of his sister outside the courthouse.

    "She wanted him to leave, and I guess he didn’t want to leave. So he took it upon himself to kill my sister," he said.

    The Gwinnett County District Attorney’s Office confirmed to FOX 5 that Dumas is not in jail but declined to disclose his exact whereabouts or medical status, stating, "This is an open case that has yet to be indicted."

    What's next:
    The timeline for an indictment remains uncertain. Attempts to reach Dumas’ listed attorney for comment were unsuccessful. Meanwhile, Greg Weaver says he will keep fighting for justice.

    "Gwinnett County needs to do the right thing. Do the right thing," he said. "Find somewhere for this guy to be in your custody until he’s able to stand trial."
